China’s dramatically increasing economic development has established a major presence in the global market since the commencement of its ‘Open Door’ policy in December 1978. An important result of this policy’s implementation was the involvement of foreign direct investment in China’s economic reform. This subject provides an introduction to the legal system of China and its embedded legal culture; then focusses on the development of China’s foreign investment law regime mainly including foreign investment law, contract law, company law and dispute resolution mechanisms. It aims to enable students to acquire an understanding of China’s commercial law system for foreign participation and to discuss practical issues, including the establishment of a corporate operation in China and related negotiation processes and to explore dispute resolution mechanisms in the current legal environment of China.
